The rules of using our product.

1. Acceptance of Terms

These Terms and Conditions (“Terms”) form a binding agreement between you (“you”, the “User”) and PEB Optimization (“we”, “us”, or the “Company”). By purchasing, downloading, installing, or using the PEB Optimization Tool for STAAD (“the Software”), you confirm that you have read, understood, and agreed to these Terms.

If you do not accept these Terms, you must not purchase or use the Software.

2. About the Service

The Software is a deterministic optimization tool that runs alongside Bentley STAAD CONNECT and assists with sizing of built-up tapered I-section geometry for PEB main frames. It checks designs against IS 800 and AISC LRFD/ASD code clauses. It is sold as a licensed application for individual professional use.

3. License Grant

Subject to your payment of the applicable fee and continued compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software on a single machine, for the duration of your active subscription.

One paid license = one active machine. You may deactivate a machine and activate the license on a different machine; concurrent activation on multiple machines under a single license is not permitted.

4. Permitted Use

You may use the Software for your professional structural design work, including commercial projects, subject to these Terms.

5. Restrictions

You agree not to:

• Copy, redistribute, sub-license, sell, lease, or rent the Software or any of its components.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Software, except where permitted by applicable law.
• Modify the Software or create derivative works.
• Remove, alter, or obscure any proprietary notices, branding, or license-validation mechanisms.
• Share your license key with any third party.
• Use the Software in any way that violates applicable law or infringes the rights of others.
• Use the Software with cracked, pirated, or unlicensed copies of STAAD or other host software.

6. Subscription, Renewal, and Cancellation

The Software is sold as a monthly or annual subscription, or under a custom enterprise agreement.

• Monthly subscription: billed once for one calendar month from the date of purchase. You may choose not to renew.
• Annual subscription: billed once for twelve calendar months from the date of purchase. You may choose not to renew.
• Enterprise: billing terms are governed by the separately-agreed enterprise contract.

Subscriptions do not auto-renew. To continue using the Software after your subscription expires, you must purchase a renewal.

7. Payment Terms

All payments are processed by Razorpay. We accept payments in INR and USD as displayed on the purchase page. All prices are exclusive of any applicable taxes unless otherwise stated. You authorize Razorpay to charge the amount shown at checkout.

8. Refund Policy

Every purchase is covered by a 3-day money-back guarantee. Refunds and cancellations are governed by our Refund Policy, which is incorporated into these Terms by reference.

9. Delivery

The Software is delivered electronically. Delivery details and timelines are set out in our Shipping & Delivery Policy.

10. Intellectual Property

The Software, its source code, design, branding, documentation, and all related materials are the exclusive property of PEB Optimization and are protected by copyright and other intellectual property laws. These Terms do not transfer any ownership rights to you.

STAAD, STAAD.Pro, and STAAD CONNECT are trademarks of Bentley Systems, Incorporated. We are not affiliated with, endorsed by, or sponsored by Bentley Systems.

11. Disclaimer of Warranties

The Software is a design-aid tool. It performs deterministic optimization against the listed code clauses, but the engineering judgement, validation, peer review, and stamping of any structural design remain the sole responsibility of the licensed engineer using the Software.

The Software is provided “as is”, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or will produce any particular outcome.

12. Limitation of Liability

To the maximum extent permitted by applicable law, PEB Optimization shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity, arising out of or in connection with your use of the Software.

Our total aggregate liability under these Terms shall not exceed the total fees actually paid by you to us in the twelve months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless PEB Optimization and its officers, employees, and agents from any claim, loss, or demand arising out of your breach of these Terms or your misuse of the Software.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Puducherry, India.

15. Modifications to These Terms

We may update these Terms from time to time. Material changes will be communicated through the website or by email. Continued use of the Software after such changes constitutes acceptance of the updated Terms.
